A former client of Chadbourne & Parke waived its right to attorney-client privilege when it sued the firm over legal advice, a divided appeals court in Manhattan has ruled. The suit, Creditanstalt Investment Bank AG v. Chadbourne & Parke, 8361N, centers on legal advice given by the firm regarding the Russian operations of Creditanstalt Investment Bank. Creditanstalt alleged that Chadbourne gave it erroneous advice about the legality of investments in Russian securities. The company was eventually raided by Russian authorities. While the bank agreed that it had waived attorney-client privilege with respect to the securities advice, it claimed the actions taken by Russian authorities might have been caused by the bank's compliance with tax and licensure laws. The bank said its malpractice claim did not place at issue legal advice on subjects besides the securities. Manhattan Supreme Court Justice Barbara R. Kapnick disagreed, and the 1st Department affirmed this week in a 4-1 ruling

A former associate at Thacher Proffitt & Wood faces up to five years in prison after he pleaded guilty Thursday in Eastern District of New York federal court to an insider trading scheme involving his father, brother and a childhood friend who worked at Ernst & Young. The 29-year-old attorney, Amir Rosenthal, his co-defendants and several others named in a civil securities complaint earned as much as $3.7 million by trading on inside information provided by Rosenthal's 62-year-old father, Zvi, a former executive at Taro Pharmaceutical Industries, Ltd., according to prosecutors and the Securities and Exchange Commission. McKee Nelson has recruited a six-partner litigation group from the New York law office of King & Spalding. Led by Jeffrey Q. Smith, the group also includes partners Steven G. Brody, Susan F. DiCicco, Scott E. Eckas, Michael M. Gordon and Jennifer Hurley McGay. The partners are set to start at McKee Nelson on Monday, with at least 15 associates expected to move from King & Spalding in the next few weeks. It is a significant move in the litigation arena for 200-lawyer boutique McKee Nelson, founded in 1999 as an offshoot of accounting firm Ernst & Young.
